Welcome to River Brands. By accessing, browsing, or using our platform (website and mobile services), you agree to comply with and be bound by the following Terms and Conditions. Please read them carefully before using our services. If you do not agree, you may not use our platform.

1. Definitions

• “Platform” refers to the River Brands website and any related services.

• “User” means any individual using the platform, including both renters and vehicle owners.

• “Renter/Client” refers to an individual or organization booking or hiring a vehicle.

• “Owner” means an individual or organization listing a vehicle on the platform.

• “Agreement” refers to these Terms and Conditions.

2. Eligibility

• Users must be at least 18 years old to use the platform.

• Renters must hold a valid driver’s license recognized in Kenya (or relevant jurisdiction of hire).

• Owners must provide accurate and verifiable information regarding ownership and insurance of listed vehicles.

3. Use of the Platform

• Users agree to provide accurate, current, and complete information during registration.

• Users are responsible for maintaining the confidentiality of their account credentials.

• Any fraudulent, illegal, or unauthorized use of the platform may result in account suspension or termination.

4. Vehicle Listings (For Owners)

• Owners must ensure vehicles are roadworthy, insured, and legally compliant.

• Owners are responsible for the accuracy of the information provided (pricing, availability, description, photos).

• River Brands reserves the right to verify or remove any listing that violates these Terms.

5. Booking & Rental (For Renters)

• Renters must use vehicles only for lawful purposes.

• Renters are responsible for returning vehicles in the same condition as received.

• Any damages, traffic fines, or violations incurred during the rental period are the renter’s responsibility.

6. Payments

• All payments are processed through secure third-party gateways integrated into the platform.

• River Brands may charge a commission/transaction fee on each booking.

• Refunds or cancellations are subject to the Cancellation Policy outlined on the platform.

7. Insurance & Liability

• Owners must maintain valid insurance for their vehicles.

• Renters are encouraged to verify insurance coverage before hiring a vehicle.

• River Brands acts solely as a platform and is not liable for accidents, damages, theft, or disputes between owners and renters.

8. Cancellations & Refunds

• Cancellations made within [X hours/days] may qualify for a partial or full refund.

• No-shows or late cancellations may result in forfeiture of rental fees.

• River Brands reserves the right to mediate disputes but is not obligated to guarantee refunds.

9. Prohibited Activities

Users agree not to:

• Use vehicles for illegal activities (drug transport, reckless driving, smuggling, etc.).

• Sublet or re-rent vehicles without owner consent.

• Provide false documents or impersonate another person.

10. Intellectual Property

• All content, trademarks, logos, and material on River Brands are the property of River Brands Ltd.

• Users may not reproduce, copy, or distribute platform content without written consent.

11. Privacy & Data Protection

• River Brands collects and processes personal data in accordance with its Privacy Policy.

• Users consent to their information being used for bookings, communication, and service improvements.

12. Limitation of Liability

• River Brands is not a car rental company but a facilitator/marketplace.

• River Brands is not liable for disputes, damages, losses, or accidents arising from vehicle use.

• Users release River Brands from claims related to third-party actions, misuse, or negligence.

13. Termination of Account

• River Brands may suspend or terminate user accounts if these Terms are violated.

• Users may request account deletion at any time by contacting customer support.

14. Governing Law

• These Terms shall be governed by and construed in accordance with the laws of Kenya.

• Any disputes shall be subject to the exclusive jurisdiction of Kenyan courts.

15. Amendments

• River Brands may revise these Terms at any time.

• Continued use of the platform after updates constitutes acceptance of the revised Terms.
