In fact, it is a\nstatutory presumption in most countries that the employer owns the intellectual\nproperty that an employee creates.<\/p>\n\n\n\n<p>However, an employer would be careless to assume that all rights\nof the employee over such creations are extinguished.<\/p>\n\n\n\n<p>The employee could claim rights of an author, moral rights and\nrights to object to alterations to work. Hence, it becomes critical to include\nterms determining the ownership of intellectual property in employment\ncontracts, independent contractor agreements or agreements with a consultant or\ndesigner.<\/p>\n\n\n\n<p>Without a clear understanding, these issues could present\nchallenges for employees and employers alike.<\/p>\n\n\n\n<p>In Kenya, IP is protected under Article 40 (5) of the\nConstitution that obliges the State to support, promote and protect the\nintellectual property rights\u2026<a href=\"https:\/\/www.businessdailyafrica.com\/lifestyle\/pfinance\/Employees--right-to-intellectual-property\/4258410-5284572-yiimqaz\/index.html\">Read\nmore&gt;&gt;<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>By OSCAR ONYANGO Companies often hire and invest in employees to develop new products, improve processes, create new technologies and develop new markets.
